The Law was written by Bastiat to make an effort of controlling the socialistic state that seemed to surpass the usual limits, which were exercised in France. The French had decided to buy the thought that the government should be held responsible for everything that is related to the health, happiness and fortunes of its citizens, just as the Americans did. In other words, Bastian’s The Law carries out a systematic inquiry to discover facts. It also examines the facts of what happens in a society when the law becomes an instrument of attack that is used by the people who are in power to control and make the population their slaves. The citizens should combat the issue of using law as an instrument of attack by ensuring the appointment of legal legislators.
The author starts by explaining the meaning of the law. Law is an organization that has a collection of the right to lawful defense of an individual. In addition, it replaces a force that is common to forces of an individual. The common force normally only performs things that the forces of individual have been caused by nature or are right to be done lawfully. These can be the protection of people, freedom from arbitrary and their properties. In addition, it should ensure that the right of each person is maintained and to let justice hold royal office over the individual.
Since individuals are not expected to use physical action to make other people behave in a particular manner, groups of individuals, which include the governments, corporations and organizations, also should not be given the permission by the law to force people to perform certain actions in a strange manner. This is because there is no particular individual acting in a separate way can use force lawfully in order to damage the rights of others. It is nothing to the combination of individual forces that is organized to logically go in a in a way that that the same principle is also used by the force.
Bastiat then gives an account in words of the problem that he is taking aggressive action against in his book, perversion of the law. The law has also enabled the putting to an end of the existence of its own objective. It has been applicable in obliterating the justice that it was expected to maintain. Furthermore, the law restricted and damaged the rights which are supposed to be respected instead. The law has put collective force in a position where it is at the disposal of people who have no moral principles and who wish to exploit the person, liberty, and other people’s property without risk. It has changed plunder into a right. The changing of plunder into a right was because it wanted to protect plunder. It has also turned a defense that is lawful into an act that constitutes an offense, this was done in order to punish the defense that is lawful. The law has been altered from its original state to a distortion by the influence of two causes that are entirely different. The causes are greed that is stupid and philanthropy that is false.
The greed is portrayed when those in power are using the law to take possession of properties of other people hence performing the legalized plunder. It is really much easier to take wealth from other people who worked for it instead of working to gain the wealth. He says that since the man is inclined in a natural manner to be sheltered from pain, it goes the same way that men will turn to plunder whenever they feel plunder is an easier way than working. The false philanthropy is performed when some individuals are using the law make an engagement with legalized plunder by not being concerned chiefly with their own personal profit but because they have a belief that by taking the property and wealth of other people they will be able to provide assistance to those who are needy.
Bastiat has often used the term lawful plunder in order to describe the perversion of law. He allows us to have a test where we can acknowledge the existence of lawful plunder. He talks about seeing if the law takes from some people what belongs to them, and gives it to another person who is not supposed to own it. He also asks us to see if one citizen benefits at the expense of the other by trying to do what the other citizen cannot do without the act of committing a crime. The act takes place if such a law which may be a case that is caused to remain alone is not formally put to an end with immediate effect, it will extend its surface area, occur in several different ways and exist into a set of connected parts forming a complex whole in particular.
To some place along the line, the species of America of plunder that is lawful took control and moved over a large area like a weed. During the time, it grew and became more mature turning to a large system and consisting of many different and connected parts than any other in history. Bastiat suggested that the state of believing that through the government is the only way that people are capable of being provided particular services emerges from an improper view of humanity, a view that makes sure that the individuals who are free lack the compassion, matter of interest and capability to assist those that are in need.
In conclusion, the appointment of legislators who are connected with the law seems a perfect way to deal with case of using law to mistreat individuals.
